1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("Member," "you," or "your") and BookShook ("BookShook," "we," "us," or "our") governing your access to and use of the BookShook mobile application, website, and all related services (collectively, the "Platform").

By registering an account, subscribing, or otherwise using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety. These Terms apply to all visitors, users, and members of the Platform.

2. Eligibility

To use BookShook, you must:

• Be at least 18 years of age.
• Be a resident of India or any jurisdiction where use of the Platform is not prohibited by law.
• Have been invited by an existing BookShook member and possess a valid Introducer User ID at the time of registration.
• Provide accurate, current, and complete information during the registration process.
• Not have had a previous BookShook account terminated for violation of these Terms.

By using the Platform, you represent and warrant that you meet all of the above eligibility requirements.

3. Account Registration & Security

To access BookShook's features, you must create an account by:

• Providing a valid email address and completing email verification.
• Setting a 4-digit PIN to secure your account.
• Providing your Introducer's User ID, which will be verified against our member records.
• Uploading a profile photo and entering your full name.

You are solely responsible for maintaining the confidentiality of your account credentials, including your PIN. You agree to notify us immediately at support@bookshook.in if you suspect any unauthorised access to your account.

BookShook will never ask you for your PIN via email, phone, or any channel other than the official app login screen. You must not share your PIN with anyone, including BookShook staff.

Each individual may hold only one active BookShook account. Creating multiple accounts to circumvent any restrictions or to artificially inflate referral earnings is strictly prohibited and may result in permanent account termination.

4. Subscription & Payment

Subscription Plans: BookShook offers the following subscription plans:

• Monthly Plan: ₹99 per month, billed monthly.
• Annual Plan: ₹999 per year, billed annually.

All subscription fees are stated in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.

Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 48 hours before the renewal date. By subscribing, you authorise BookShook to charge your payment method on a recurring basis.

Refund Policy: We offer a 7-day refund for first-time Annual Plan subscribers who are not satisfied. Refunds are not available for Monthly Plan subscribers or renewals. Refund requests must be submitted to support@bookshook.in within 7 days of payment.

Subscription Benefits: An active subscription grants you access to BookShook's full eBook library for the duration of your subscription period. Access is personal and non-transferable.

5. Referral Program

BookShook operates a referral program that rewards members for introducing new subscribers to the Platform. The following rules govern this program:

• Each registered member is assigned a unique User ID that can be shared with potential new members.
• A referral bonus is earned when a person you have introduced registers using your User ID and completes a paid subscription.
• Bonuses are also earned from members introduced by people in your network, up to the levels defined in the current bonus structure published in the app.
• Referral bonuses are credited to your BookShook wallet and may be withdrawn to your verified bank account.
• You must have an active subscription at the time of the referral event to be eligible for the associated bonus.

Prohibited Referral Activities: The following are strictly prohibited and will result in account termination and forfeiture of earnings:

• Creating fake or duplicate accounts to generate referral bonuses.
• Using automated tools, bots, or scripts to create referral activity.
• Misrepresenting the BookShook platform or making false claims to recruit members.
• Self-referrals or referrals among family members using different accounts solely for bonus generation.
• Any other activity intended to fraudulently generate referral bonuses.

BookShook reserves the right to modify, suspend, or terminate the referral program at any time with 30 days' notice to existing members.

6. Earnings & Withdrawals

Referral bonuses accumulated in your BookShook wallet are subject to the following terms:

• A minimum balance of ₹500 is required to initiate a withdrawal.
• You must add and verify a valid Indian bank account before initiating any withdrawal.
• Withdrawals are processed within 5–7 business days from the date of request.
• BookShook may deduct applicable Tax Deducted at Source (TDS) as required under Indian tax law. You are responsible for reporting and paying all taxes on your earnings.
• Bonus earnings are non-transferable and cannot be used to pay for subscriptions.
• In cases of suspected fraud or policy violation, BookShook reserves the right to withhold withdrawals pending investigation.

7. Content & Intellectual Property

All eBooks, text, images, logos, trademarks, and other content available on the BookShook Platform ("Content") are owned by BookShook or licensed from third parties. This Content is protected by applicable intellectual property laws.

Your subscription grants you a limited, personal, non-exclusive, non-transferable licence to access and read the Content for personal, non-commercial use only. You may not:

• Copy, reproduce, distribute, or transmit any Content outside the Platform.
• Download, store, or cache eBook content in any form.
• Modify, adapt, translate, or create derivative works from any Content.
• Use any Content for commercial purposes.
• Remove or alter any copyright, trademark, or other proprietary notices.

Any unauthorised use of BookShook Content may violate copyright law and constitutes a material breach of these Terms, resulting in immediate account termination.

8. Acceptable Use Policy

You agree to use BookShook only for lawful purposes and in accordance with these Terms. You must not:

• Use the Platform to transmit spam, unsolicited communications, or harmful content.
• Attempt to gain unauthorised access to any part of the Platform or its systems.
• Interfere with or disrupt the integrity or performance of the Platform.
• Engage in any activity that could damage the reputation of BookShook or its members.
• Make false, misleading, or defamatory statements about BookShook or its services.
• Violate any applicable local, national, or international laws or regulations.

9. Termination & Suspension

By You: You may close your account at any time by contacting support@bookshook.in. Account closure will result in the immediate loss of access to the eBook library and forfeiture of any pending referral earnings that do not meet the minimum withdrawal threshold.

By BookShook: We reserve the right to suspend or permanently terminate your account at our sole discretion if you:

• Violate any provision of these Terms.
• Engage in fraudulent activity, including manipulation of the referral program.
• Provide false or misleading information during registration.
• Fail to pay subscription fees when due.
• Engage in conduct that is harmful to BookShook, our members, or third parties.

Upon termination for cause, any accrued but unpaid referral bonuses may be forfeited. BookShook is not liable for any losses arising from account termination.

10. Disclaimers & Limitation of Liability

The BookShook Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law:

• BookShook makes no warranties, express or implied, regarding the availability, accuracy, or completeness of the Platform or its Content.
• We do not guarantee that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components.
• Referral bonus amounts are subject to the program structure in effect at the time of the referral event and may change without notice (with 30 days' advance notice to members).

To the maximum extent permitted by applicable law, BookShook shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of income or profits, arising from your use of or inability to use the Platform.

11. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Dispute Resolution: In the event of any dispute arising out of or in connection with these Terms or the Platform, both parties agree to first attempt resolution through informal negotiation. If the dispute cannot be resolved informally within 30 days, it shall be submitted to binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Nagpur, Maharashtra, India.

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm.

12. Changes to Terms

We may revise these Terms from time to time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page.
• Notify you via the email address associated with your account at least 14 days before changes take effect.
• Display a prominent in-app notification.

Your continued use of BookShook after the effective date of revised Terms constitutes your acceptance of those Terms. If you do not agree to the revised Terms, you must discontinue use of the Platform and may close your account.
